The general terms and conditions set out below constitute a contract establishing the general conditions governing the tele-sales operations of the E-commerce site of GilGeorges.com. By ordering from our site the Customer is implying total and unconditional acceptance of these terms and conditions.

ARTICLE 1 - PRICE Back to top
1.1 The prices of Artworks include all taxes payable in France (VAT), excluding the costs of the delivery.
1.2 In the event of a purchase for delivery to a destination outside mainland France, you the customer are the importer of the goods in question. Products despatched outside the European Union or DOM-TOM territories are liable to attract customs duties or other local taxes, import duties or state taxes. GilGeorges.com denies any liability for any of these duties, taxes or fees, which must be settled by you. You are also entirely responsible for any disclosure or payment requirements demanded by the authorities in your own country. We recommend that you inform yourself of any requirements of this sort in advance of purchase by consulting the relevant authorities in your country.
1.3 All purchases, wherever they may be placed, must be settled in Euros €.
1.4 GilGeorges.com reserves the right to alter its prices at any time without notice. Goods will be invoiced at the price payable at the time an order is placed, subject to availability.
1.5 The goods ordered remain the property of GilGeorges.com until full payment of the advertised price has been received.

2.2 GilGeorges.com reserves the right to cancel or refuse to accept an order from a customer with whom a legal dispute exists in relation to payment for a previous order.
2.3 Once you have clicked the box to confirm your order you accept without reservation all the conditions of sale herein described. Data recorded electronically or otherwise by GilGeorges.com may constitute proof of the transaction between GilGeorges.com and its customers. Data recorded by the online payment system may constitute proof of financial transactions between GilGeorges.com and its customers.
2.4 GilGeorges.com will confirm receipt of your order by electronic mail as soon as availability of the goods requested has been established and payment details have been validated.
ARTICLE 3 - ORDER PROCESSING - DELIVERY EXPECTATIONS Back to top
3.1 In the event of unavailability of the ordered product, whatever is the reason, your order will be cancelled. You will have the choice to ask either for the refunding of your order, or to choose another product.
3.2 The artist commits himself with all implementing for a fast delivery (delivery time: 5-15 business days).
3.3 Shipping costs will be determined during your checkout. The price varies according to the weight of the order, of dimensions of the good and the country of delivery. The forwarding costs can also be already included in the total price of the good.
3.4 On the day of delivery, the customer is invited to confirm to GilGeorges.com the receipt of the good bought.
3.5 Claims about the delivery:
It is your responsibility, in the case of a missing or damaged item, to make precise and detailed reserves to the carrier (and copy to GilGeorges.com) at the time of delivery or, at the latest, within 48 hours.
3.6 Claims about the goods:
All claims against a good whatever the relative nature must be addressed to GilGeorges.com by registered letter with acknowledgement receipt. If a deterioration or a flaw in the good is noticed by the customer he must claim within a delay of 7 days following the date of receipt.

4.1 Settlement of your purchases may be made in Euros €, by one of the following methods:

Delivery will be made as soon as the cheque has been received. Please remember to note your order reference details on the back of the cheque.

ARTICLE 5 - RETURN PRIVILEGE - RETURNS, REFUNDS & EXCHANGES Back to top
5.1 You may return your goods within 14 days of receipt without prejudice, that means we exchange the item according to your wishes or return the money. This is only valid if the goods still are in perfect condition. The shipping costs have to be paid by the customer unless it was our shipping error; the returning good does't conform to the purchase order of the Customer; the effective characteristics of the artwork doesn't conform to the artwork description offered to sale; the good is faded.

To return your item(s) please pack them in the original box and send them to the artist. You shall support the transport risks of the item(s) during its return. All artwork shall be insured for its purchase price.
5.3 You can expect a refund in the same form of payment originally used for purchase within 14 business days of our receiving your return, made out to the customer name given on the original order form and sent to the invoice address given. If your return is not due to our error, we will deduct the shipping costs from your refund.
5.4 No goods will be accepted as partial reimbursement, for whatever reason.
5.5 Return intructions:
Prior to returning any item(s) to GilGeorges.com, you must receive authorization from our Customer Service Department. To request authorization please send e-mail to returns@gilgeorges.com with the following details:
- Order #, First & Last Name.
- Item #(s) you want to return.
- Specify reason for return: damaged, received incorrect item or size, received duplicate item, quality of item not as expected, etc.
- Specify what action you would like us to take for you: Free Replacement or Refund?
- Wait for our Customer Service team to email you with your Return Authorization & Instructions.

7.1 How and when we collect information:

In accordance with article 1148 of the French Civil Code, GilGeorges.com cannot be held responsible or be considered to be at fault in the processing of your order, if any delay or inactivity is the result of "force majeure" (fire, flooding, earthquake, explosion, accident, war, riot, epidemic, strike, carriage impossibility, and legal or government actions).

9.1 GilGeorges.com undertakes to respect any legal guarantee to which you are entitled. Products on our website are offered in accordance with the requirements of French law; however, we cannot be held responsible for violations of the law in any country outside France to which they may be delivered. We therefore recommend that you enquire about the legal position in your own country before you place your order.
9.2 Your purchases are insured to cover any damages incurred during shipping and delivery. Your purchases will be completely refunded in the event of any damage incurred during delivery.
9.3 You will receive a certificate of authenticity, signed by the artist. You are therefore guaranteed with the origin of the artwork and its specific characteristics.
ARTICLE 10 - RESPONSABILITIES Back to top
10.1 Artist declares and guarantees that artworks are solely owned by him/her, neither borrowed or stolen from, nor owned in part or in full by, any other party. Artist engages so that the artwork description corresponds to the effective characteristics of the artwork offered to sale.
10.2 Artist agrees to have full rights and powers of sale and transfer; that the artwork is not already sold, mortgaged, burdened or generally delegated to a third person and that the operation being realized doesn't violate a third persons rights. Artist states when putting the artwork on line that his sale conforms to the legal regulations in force, notably regarding the code of intellectual ownership and of all other specific rules; there is no judgment outstanding against Artist.
ARTICLE 11 - AUTHOR'S RIGHTS Back to top
As the author of the work of art, by French law the artist retains the right to any royalties pertaining to his/her work. The rights of representation and reproduction of the works featured on the GilGeorges.com website belong to their authors and to GilGeorges.com. Their joint authorisation is required for any exploitation of these rights. Your rights over the work purchased are therefore limited to its private enjoyment, and exclude any right of representation or reproduction.
ARTICLE 12 - LITIGATIONS - APPLICABLE LAW Back to top
This contract is governed by French law. Any dispute concerning the drafting, interpretation or execution of this contract will be submitted to the exclusive competence of the Commercial Court of Nancy (Tribunal de Commerce de Nancy).
